Daeryun receives decision to provisionally seize bond in lawsuit requesting refund of lodging expenses

A lodging platform that ended up being sued for failing to cancel same-day reservations received a decision to temporarily seize its bonds, and Daeryun Law Firm (Limited) announced on the 12th that it would recruit affected consumers to file a class action lawsuit.

Recently, complaints have been coming in online communities and social media that people have requested refunds because the quality is significantly lower than the accommodations they booked, but the lodging platform refuses refunds, citing internal regulations.

Daeryun pointed out, “The damage is growing uncontrollably due to accommodation platforms that enforce a no-refund policy even though consumers have expressed their intention to withdraw their subscription within a legal period.”

The legal community argues that the accommodation platform is only in charge of brokerage and is not a party to the contract, so it is not subject to the application of the Act on Regulation of Terms and Conditions (Terms and Conditions Act), and they unanimously emphasize that the accommodation company is also not a party to the contract.

However, Daeryun said, "The number of victims is continuing to increase. We are currently receiving a flood of inquiries from consumers who have been harmed in similar cases," and added, "We are preparing a class action lawsuit to claim compensation for damages as well as refunds for lodging expenses. We are recruiting participants. The results of the lawsuit for refund of lodging expenses, which we started earlier, will be the first step in class action lawsuits to be filed in the future."

Previously, Daeryun received a decision to temporarily seize the bond in a lawsuit against the lodging platform for the return of lodging expenses.

Daeryun argued, "The accommodation platform's refund policy violates a number of laws, including the Electronic Commerce Act and the Terms and Conditions Act," and added, "The damaged consumer's claim for the return of unfair profits is a legitimate request, and the refund policy can be considered invalid."
