Man in his 60s sentenced to 7 years in prison for breaking into a neighbor's house and attempting sexual assault

A man who broke into his neighbor's home and attempted to sexually assault him has been sentenced to prison.

According to the legal community on the 14th, the 12th Criminal Division of the Daegu District Court sentenced Mr. A, a man in his 60s indicted on charges of home invasion-like rape, to 7 years in prison on the 4th of last month and ordered him to complete an 80-hour sexual violence treatment program.

Last year, Mr. A was accused of visiting the home of his neighbor, Ms. B, a woman in her 60s, attempting to sexually assault her and filming her body.

He was also accused of taking Mr. B's cell phone and confining him.

At that time, Mr. B succeeded in escaping by jumping out of the window without Mr. A's knowledge, but his leg was seriously injured and he was diagnosed with 8 weeks of dislocation.

As a result of the investigation, it was revealed that Mr. A went to Mr. B's house and made him open the door to settle the payment, and then committed this crime.

Mr. A denied some of the charges.

It is true that he attempted sexual assault, but he entered the house with Mr. B's permission.

They also claimed that Mr. B was in poor health, including vomiting, so he stayed at home to take care of him, and that he was never confined.

The court sentenced Mr. A to 7 years in prison.

The court said, “The defendant came into the living room wearing shoes and broke the door even though the victim went into the master bedroom and locked it,” adding, “This cannot be considered a normal method of entry.”

He then stated the reason for the sentencing, saying, "It is difficult to understand that the vomiting victim was left naked even though there was no intention to confine him, and there is no reason to prevent him from using his cell phone."

Attorney Kim Jin-won of Daeryun Law Firm, who represented Mr. B in this case, said, "If you entered the house for the purpose of illegal activity, the crime of trespassing is established regardless of whether the resident gave permission or not," and added, "Even if you received permission from B, it has no effect on establishing the crime of trespassing because you committed the crime."
