Brokerage assistant who stole 7,000,000 down payment sentenced to prison...Law "Both the landlord and the tenant were deceived"

An assistant real estate agent who deceived landlords and tenants and stole tens of millions of won in deposits was sentenced to prison.

On the 25th of last month, the Seoul Eastern District Court sentenced Mr. A, a brokerage assistant, to six months in prison, who was indicted on charges of embezzlement and forgery of private documents.

Mr. A is accused of brokering a lease contract with a sales price of 200 million won in 2022 and embezzling 70 million won of the deposit paid by tenant B.

It was found that Mr. A continued to engage in illegal activities, including brokering contracts, even though he was an assistant broker.

According to the Licensed Real Estate Brokerage Act, a real estate agent assistant is a person employed by a licensed real estate agent and can only perform simple auxiliary tasks such as on-site guidance on brokerage items or general affairs.

It is reported that Mr. A forged a contract, delivered forged private documents to Mr. B and others, and used most of the stolen money for personal investment.

During the trial, Mr. A argued that since he showed the contract to the landlord and received his signature and seal, charges such as forgery of a private document were not established.

The court ruled that Mr. A was guilty of forging a private document because he deceived the landlord into signing and sealing a document against the landlord's will, and sentenced Mr. A to prison.

The court also pointed out, "Although the defendant admits to some crimes, it is questionable whether he truly reflects and regrets this incident, considering his statements and attitude in court."

Attorney Park Jeong-ho of Daeryun Law Firm, who is the legal representative of victim B, emphasized, "This case is a serious economic crime in which Mr. A, who was in charge of assisting brokerage, abused his trust to embezzle customers' funds and forged and used private documents such as contracts to conceal this."
