To complain about inter-floor noise, he went to the house above and said, "I will find out about the daycare center he goes to."
Prosecutors say, “There is no use of profanity or corporal power… I cannot conclude that there was any notice of harm in the remarks.”

A woman who was handed over to the prosecution on charges of making threatening remarks to her neighbor's child during a conflict over noise between floors was acquitted.

On the 17th of last month, the Uijeongbu District Prosecutors' Office decided not to indict Mr. A, in his 30s, who was sent on charges of threatening.

Around June of last year, Mr. A was accused of visiting the house above him to protest the noise between floors and threatening his neighbor Mr. B's child, saying, "I will find out which daycare center you go to."

Person A denied the charges.

They claim that they only went there to request that noise between floors be reduced, and that there was no intention to threaten them.

At the time, Mr. B refused the request, saying, “The child is young and does not understand what is being said,” but he refuted that he had made the statement to confirm the facts.

The prosecution decided not to indict Mr. A.

The prosecution said, "There is no evidence of the suspect swearing at the victim or using physical force," and added, "It is difficult to conclude that there was a specific notice of harm to the children in the suspect's remarks."

Lawyer Jeong Jae-bong of Daeryun Law Firm, who represented Mr. A, explained, "A threat for the crime of intimidation is a notice of harm to the extent of causing fear, and whether or not the threat was intentional must be judged by taking into account the context leading up to the act and the relationship with the victim," adding, "By explaining the inter-floor noise situation that Mr. A was experiencing and the content of his repeated requests to Mr. B to refrain, we proved that there was no intention of intimidation in the statement."
