While running a trading business, I have often experienced difficulties with payment, and I heard from people around me that there is a payment method called a letter of credit. What is a letter of credit in trade? I would like to consult with a customs attorney and learn specifically what role a letter of credit plays in international trade and what advantages it offers to exporters and importers.

Hello. This is a customs attorney at Daeryun Law LLC.
A letter of credit is one of the payment methods used to safely conduct transactions between an importer and an exporter in international trade.
A letter of credit is a method by which the importer's bank guarantees payment to the exporter, allowing the exporter to receive payment from the importer's bank after fulfilling the conditions of the letter of credit.
This payment method enhances the safety of the transaction because the exporter does not rely on the importer's credit but instead receives the bank's payment guarantee.
A letter of credit plays an important role in ensuring reliability and safety in international transactions.
Through a letter of credit, the exporter can eliminate uncertainty regarding the importer's ability to pay, and the importer can reduce risk because payment is not made until the goods are received.
Once a letter of credit is issued, because the bank guarantees payment, the exporter can receive payment upon satisfying certain conditions even if the importer does not pay.
If the exporter does not precisely fulfill the conditions specified in the letter of credit, the importer may withhold payment, so the importer pays only when the quality, quantity, and delivery conditions of the goods are firmly guaranteed.
A letter of credit functions as a protective device for both the exporter and the importer in international transactions.
However, since accurate submission of documents and confirmation of whether the conditions are met are essential, when using a letter of credit it is advisable to thoroughly confirm and prepare all conditions through the advice of a customs attorney.
To open a letter of credit, you need a letter of credit application, a letter of credit transaction agreement, an offer sheet, and a deposit of collateral, among other things, and since these are difficult for an individual to prepare, please seek the assistance of a customs attorney.
