If a drug specialist attorney is available, I would appreciate an answer to my question. I am currently in a situation where I have difficulty moving and cannot go to the hospital, but the drug I am prescribed turns out to be a controlled substance. So I would like to receive a proxy prescription, but is proxy prescription of controlled-substance drugs illegal? Or are there exceptions?

Hello. This is a drug specialist attorney of Daeryun Law Firm.
The act of receiving a proxy prescription of controlled-substance drugs is, in principle, illegal.
Although the level of punishment may vary depending on the type of the prescribed drug, imprisonment for up to 10 years or a fine of not more than 100 million won may be imposed.
In addition, you must note that even a person who requested a proxy prescription may receive the same punishment as the person who received the prescription.
However, in exceptional situations such as the following, a proxy prescription of controlled substances may be permitted.
As a drug specialist attorney, I will briefly explain.
▶ When revisiting for the same illness
▶ When the same prescription has been repeated over a long period and the possibility of change is low
▶ When the patient has difficulty moving or is unconscious (when an agent visits with supporting documents)
▶ When the attending physician has recognized stability
Here, even in a situation where a proxy prescription of controlled substances is possible, only persons such as a spouse, lineal blood relatives and the spouses of lineal blood relatives, siblings, the siblings of a spouse, and lineal blood relatives can receive it.
Please accurately ascertain the details through a consultation with a drug specialist attorney.
