The sentencing for the crime of tax evasion is not determined merely by the amount of the evaded tax; it is judged by comprehensively considering various factors such as the motive for the act, the degree of participation, and the attitude after the offense.
For example, if a person participated passively in accordance with external pressure or instructions, or if there was almost no actual gain, the culpability may be evaluated as relatively light.
In addition, if the timing of payment was merely delayed without a clear purpose of tax avoidance, or if the offense was committed with willful negligence, the intent may be regarded as low, which can serve as a factor for reduction of sentence.
An offense committed in a state of mental weakness, or an act committed under very difficult economic circumstances, may also be recognized as grounds for extenuating circumstances.
If a person surrenders after the offense or reports internal wrongdoing, or shows an effort to fulfill the tax obligation through an amended return or a return filed after the deadline, this also has a positive influence on mitigation.
If there are circumstances showing that the person voluntarily paid at least part of the evaded tax or is sincerely making efforts to pay, or if at least part of that tax amount has already been collected or is likely to be collected soon, the possibility of a lower sentence is high.
In addition, having no history of criminal punishment and an attitude of deeply reflecting on the offense also act as favorable circumstances in sentencing.
Ultimately, the level of punishment for the crime of tax evasion is not determined solely on the basis of the amount; it is judged by examining the specific circumstances and the offender's attitude overall.
Therefore, if there are grounds that may affect sentencing, it is important to organize and assert them well during the trial process.
