I was caught by an investigative agency while cultivating marijuana. I had no intention of selling it at all and just meant to use it by myself, but I am so afraid of receiving heavy punishment that I cannot even sleep properly.. I would be grateful if you, the marijuana attorney, could advise me in detail on whether there is a possibility of an actual custodial sentence for cultivating marijuana alone and on how I should respond..!

Hello. I am a marijuana attorney. Marijuana is a type of narcotic made by processing the leaves or flowers of the cannabis plant, and in our country its smoking or distribution is prohibited.
At this point, one of the things that becomes an issue is cannabis cultivation. Cannabis cultivation constitutes an illegal act in all cases except where permission is obtained from the local government for the purpose of harvesting fiber or seeds.
According to Article 61 of the Act on the Control of Narcotics, if a person who is not a narcotics handler cultivates·possesses·owns·transfers·transports·stores cannabis or uses it, they are punished by imprisonment for up to 5 years or a fine of up to 50 million won.
If you are caught cultivating marijuana, because that in itself is an illegal act, you become subject to heavy punishment even if you did not smoke the marijuana.
Drug-related cases are highly likely to lead to a detention investigation upon detection. If there are grounds to be taken into account regarding the participation in or the motive for the crime, you should lower the sentence for the drug punishment by methods such as proving these.
Please keep in mind that if you promptly receive the help of a marijuana attorney and respond strategically, the possibility of getting out of this difficult situation increases.
