My father passed away, and I am carrying out the inheritance procedure, but the real estate is divided into several parcels, and all of the siblings, as heirs, must participate. I would like to know exactly what real estate inheritance documents I should prepare. I am also curious about whether the required documents differ when the inherited property is of various types, such as land, buildings, and forest land, and whether there are additional documents needed when an agreement among the heirs is required. I heard that if a mistake occurs in the document preparation process while carrying out the inheritance procedure, it can cause a delay in registration or tax problems, so could you also explain what points I should be particularly careful about?

Hello. This is a real estate attorney at Daeryun Law LLC.
The real estate inheritance procedure may appear on the surface to be a simple matter of transferring registration, but in reality it requires detailed review, such as confirming the scope of the heirs, distinguishing the inherited property by type, and ascertaining the rights and obligations as of the time of death.
The documents that must be submitted to inherit real estate are divided into the basic documents prescribed by law and additional documents that vary depending on the composition of the heirs and the form of the real estate.
An error at this stage can lead not only to a delay in registration but also to problems with additional inheritance tax and disputes among the heirs, so careful preparation is necessary.
First, the documents concerning the determination of the heirs are the most important; basically, you need the decedent's basic certificate, family relation certificate, and marriage relation certificate, the heirs' basic certificates and family relation certificates, and abstracts of resident registration, among others.
Next, the real estate inheritance documents include a certified copy of the real estate register, a land ledger or building ledger, a cadastral map and a forest map, and documents confirming whether there is a co-ownership share, among others.
The documents differ depending on whether it is land or a building and whether it is solely owned or co-owned, and in the case of a building, whether it is an unauthorized building or an unregistered building must also be reviewed.
Where the heirs reach an agreement on the division of the inherited property, a written agreement on the division of the inherited property is essential.
The written agreement must be personally signed and sealed by all of the heirs, and if the seal is affixed incorrectly or the certificate of seal impression is omitted, the registration is often rejected. In particular, cases where there is an heir residing overseas or an heir who cannot be reached are a major cause of inheritance disputes, so professional coordination and procedural management are needed at this stage.
In addition, at the real estate inheritance registration stage, documents confirming the fact of the decedent's death, the heirs' certificates of seal impression, powers of attorney for each heir (if necessary), and an inheritance tax return or a certificate of payment may be required.
The filing deadline for inheritance tax is very strict, and if the registration procedure is not carried out concurrently in accordance with it, a separate additional tax problem can arise.
Real estate inheritance documents come in a great many types, and the required documents can vary depending on the situation; because the omission of a single document or an error in the manner of preparation can delay the entire inheritance or cause a dispute, it is safest to proceed with an expert's review from the outset.
