Hello, narcotics attorney. As a hobby, I play soccer after work. When I got injured while playing soccer, a friend gave me a fentanyl patch. But since I understand that fentanyl itself is a narcotic substance, I have not actually used it. If it is permissible to use it, I would like to; may I use it?

Hello. This is a narcotics attorney at Daeryun Law LLC.
A fentanyl patch is a painkiller classified as a medical narcotic.
Therefore, receiving it from another person and using it without a lawful prescription from a physician is not only unsafe but also an act strictly prohibited under the Narcotics Control Act.
In addition, to prevent the misuse and abuse of narcotics, the Ministry of Food and Drug Safety restricts the handling or use of such substances by non-medical personnel, and using another person's prescription at your own discretion may give rise to legal liability.
If you were to use it at your own discretion, it would be regarded as a violation of the Narcotics Control Act, and you could be punished by imprisonment for up to 10 years or a fine not exceeding 100 million won.
Therefore, you should not use the fentanyl patch you received from your friend; for treatment of your injury, you must be treated with medication that is safely managed through a physician's diagnosis and prescription.
For details related to the Narcotics Control Act, we recommend confirming them through a consultation with a narcotics attorney.
Based on the relevant statutes and precedents, a narcotics attorney provides specific advice and response measures suited to the client's situation, within a safe and lawful scope.
