Q
Do I have to get divorced in order to proceed with a lawsuit against the spouse's affair partner?
My husband had an affair with an employee at his company. I found out a little while ago, and my husband begged me for forgiveness, saying he was sorry. Because my husband apologized and we have children, I do not want to divorce him. I just want to proceed with a lawsuit against the spouse's affair partner against that female employee. Do I really have to get divorced in order to proceed with such a lawsuit? If I do not divorce, can I not sue?

International divorce attorney, which country's law applies when divorcing a foreign spouse?
I lived with my foreign husband for about a year, but our personalities are so incompatible that I am going to proceed with a divorce. But since he is a foreigner, I am curious about which country's law I must follow if I get divorced. If I proceed with a divorce, which country's law applies? If there is an international divorce attorney available, please let me know.

A court-appointed attorney has already been assigned, so is it possible to retain a private attorney?
A court-appointed attorney was assigned to my family member who was detained in a criminal case, and I have now managed to raise some money by borrowing from several sources. Even at this stage, I would like to find another attorney or law firm so that my family member can be represented by an attorney we are satisfied with. Perhaps it is only my impression, but the current attorney does not seem to be paying proper attention, and my family member says communication is difficult, which troubles me as well. I would like to ask whether it is possible to switch back to a privately retained attorney.

For an unjust summary indictment, how do I apply for a request for a formal trial?
I committed drunk driving and have received a summary indictment. My alcohol level was not that high, and I did not cause any particular accident, so I was not worrying much, but a fine was imposed by summary order. I heard that a fine also leaves a criminal record. In this case, do I have to endure it, or is there another way?

What is the difference between suspension of sentencing and a suspended sentence?
I am in a situation where I received a consultation on a criminal case from another attorney. I was told that the best outcome for my case would be, if I am fortunate, a suspended sentence. Also, when I searched the internet, there were cases in which people received a suspension of sentencing. Are suspension of sentencing and a suspended sentence the same thing? Or is a suspended sentence worse?

I committed several crimes at the same time. How is punishment for concurrent crimes determined?
The matter has become complicated, so it turns out I committed several violent criminal offenses at the same time. I heard that in such a case one is punished for concurrent crimes, and I am curious about the definition of concurrent crimes. Is the judgment based on the higher sentence for the most heavily punished crime among them, or are all the crimes added together into a term of imprisonment of a certain number of years?

By when can I file a criminal case appeal?
I was accused of committing quasi-rape while intoxicated, and out of a feeling that I was wronged and confident in myself, I responded to the case on my own. As a result, in the first-instance trial I received a suspended prison sentence, and I cannot accept this. I did not commit rape, so how can I be sentenced to imprisonment for rape? I feel so wronged that I cannot even sleep, and I wish to respond together with an attorney. Through a criminal case appeal, I intend to pursue the criminal appeal procedure and obtain a result I need not be ashamed of. What should I do to file a criminal case appeal for a sex offense?

I received a notice that I must undergo a police investigation; what happens if I do not go?
I got caught up in an incident involving assault and the like, and at the time I thought it was just a mishap that had been settled. However, a few days ago I received a notice to come in for a police investigation, and I am currently very busy and find it difficult to make time. Is it not possible to conclude the matter through something like a written or video consultation instead of appearing for the police investigation? Is it possible for the case to end at the police stage without progressing further?
