Do you need the help of a Chinese consultation attorney? Through this article, we will explain the statutes applied and the response methods when a Chinese national is suspected of voice phishing in Korea.

Many Chinese nationals who seek a Chinese consultation attorney, when they are suspected of voice phishing or the like in Korea and become involved in a criminal case, think as follows.
"Since I hold a foreign nationality, the punishment will be light"
"I can just go back to my home country and that will be the end of it"
However, this is a misunderstanding.
Crimes that occur within Korean territory are, in principle, subject to the criminal law of the Republic of Korea.
This is because, under Article 2 of the Criminal Act (crimes within the territory), the Criminal Act of the Republic of Korea applies to every person who commits a crime within the territory of the Republic of Korea.
Therefore, if a Chinese national participates in a voice phishing crime in Korea or is suspected of fraud, aiding and abetting fraud, a violation of the Electronic Financial Transactions Act, or the like, they will be investigated and tried under Korean law in a court of the Republic of Korea.
The Korean judicial authorities define voice phishing as a serious crime and punish it very strictly.
Even if a person is not an officer of the criminal organization, there is a very high risk of receiving an actual custodial sentence or being investigated under detention through even a single act of participation, such as delivering cash, lending a bankbook, or transferring (exchanging) funds.
The statutes applied when a person becomes involved in a voice phishing crime in Korea, along with the level of punishment and disadvantages, can be organized in a table as follows.
Charge | Legal Basis | Applicable Cases | Punishment |
|---|---|---|---|
Crime of fraud | Article 347 of the Criminal Act | Where a person deceives another to obtain property or a pecuniary benefit. | Imprisonment for up to 20 years or a fine of up to 50 million won |
Aiding and abetting fraud | Articles 32 and 347 of the Criminal Act | This may be established where a person assisted while recognizing that the act was a suspicious crime, even without being certain that it was voice phishing (willful negligence). | May be punished with a reduced sentence of the crime of fraud |
Violation of the Electronic Financial Transactions Act | Article 6(3) and Article 49 of the Electronic Financial Transactions Act | Where a person transfers, lends, keeps, or delivers an access medium such as a debit card, bankbook, OTP, or password. | Imprisonment for up to 5 years or a fine of up to 30 million won |
Violation of the Act on Regulation of Concealment of Criminal Proceeds | Article 3 of the Act on Regulation and Punishment of Concealment of Criminal Proceeds | Where a person, knowing that funds are proceeds of a voice phishing crime, is involved in money laundering such as currency exchange or overseas remittance | Imprisonment for up to 5 years or a fine of up to 30 million won |
In particular, in the case of a Chinese national involved in a voice phishing case, there is a tendency to judge that the risk of flight is higher.
As a result, there is a possibility that the case will proceed as an investigation under detention through a warrant substantive examination rather than an investigation without detention, so caution is needed.
In Korea, separately from criminal punishment, victims can file a civil lawsuit against those who participated in the crime.
Under Article 750 (Contents of Tort) and Article 760 (Liability of Joint Tortfeasors) of the Civil Act, even a person who was merely a courier or a lender of a bankbook may bear joint liability to compensate for the entire amount of damage suffered by the victim.
For a foreign national such as a Chinese national staying in Korea, not all problems are resolved just because the criminal trial has ended.
This is because, after Korean criminal punishment, a bigger gateway awaits: the immigration offense examination by the immigration and foreign nationals office.
The Immigration Act of the Republic of Korea provides that, where certain grounds exist, a foreign national's status of stay may be restricted or compulsory deportation may be ordered.
The following measures, representatively, may be considered.
- Visa cancellation or restriction on changing the status of stay
- Departure order
- Compulsory deportation order
- Restriction on entry into the Republic of Korea for a certain period
In fact, where a person receives a fine or a disposition of a suspended sentence or higher in a criminal case, the immigration and foreign nationals office may conduct a separate immigration offense examination.
In this process, whether to continue permitting stay is determined by comprehensively reviewing the content of the crime, the degree of punishment, the period of stay in the country, the risk of recidivism, and so on.

If you suddenly receive contact from the police or are arrested at the scene in a situation where you cannot obtain the help of a Chinese consultation attorney, do not panic and immediately take the following 3 measures.
You should gather as much material as possible to prove that you did not know you were a member of a Korean voice phishing criminal organization, that is, that you had 'no criminal intent.'
For example, preserving the following materials may be helpful.
- WeChat and KakaoTalk conversation histories
- Screenshots of the job posting
- Records of currency exchange or remittance requests
- Content of the promised wages
- Account deposit and withdrawal records
- Call logs and text messages
One point to note in particular is that if you delete conversation histories because you feel wronged, it may instead be mistaken for an attempt to destroy evidence and become a ground for detention, so you must never delete them.
Article 180 (Interpretation) of the Criminal Procedure Act provides that "the statement of a person who does not understand the national language shall be interpreted by an interpreter."
Therefore, if you are not familiar with Korean, it is advisable to request the participation of an interpreter before the investigation.
If your statement is recorded incorrectly while being investigated without an interpreter, a credibility issue may arise in the process of later retracting it.
Also, it is important to state consistently based on the facts rather than answering by guessing at content you do not clearly remember.
In particular, for parts you do not remember, you should honestly answer that you do not know, and you must not answer "yes" unconditionally to the police's leading questions.
Because statements made in the first police investigation affect matters all the way through to trial, consistency must be maintained.
Voice phishing cases proceed very quickly in the investigation.
You should obtain the assistance of an attorney specializing in criminal matters from the stage before the first police investigation and decide the direction of your statements in order to lower the risk of detention.
For a Chinese national staying in Korea, a voice phishing case may proceed with the criminal case and the immigration procedure at the same time.
Therefore, you need to review not only the response to the investigation but also the maintenance of your status of stay, the immigration offense examination, and the possibility of compulsory deportation together.
Organizing the relevant materials from the early stage of the case and preparing a response strategy while comprehensively reviewing the criminal procedure and the immigration procedure can help reduce later disadvantages.

A Chinese consultation attorney helps a foreign national accurately explain their situation and respond when they become involved in a voice phishing case.
In fact, one ethnic Korean Chinese defendant was found to have delivered 14.3 million won on the instructions of a voice phishing organization via WeChat, and was sentenced to imprisonment for an actual term of 1 year and 6 months.
The defendant did not directly deceive the victim, participated in the crime only once, and had no prior domestic record, but the court found that he had committed the crime together with the voice phishing organization.
This case shows that it is difficult to avoid punishment merely by arguing "I only delivered the money" or "I did not know it was an organization."
Therefore, when you are investigated by the police, it is very important to accurately explain, together with objective materials, your role and how much you knew about the crime from the very beginning.

When a Chinese national becomes involved in a voice phishing case while staying in Korea, the Chinese consultation attorney focuses on reviewing the following aspects.
Review of whether a conspiracy relationship is established
For co-principal liability under Article 30 of the Criminal Act to be established, a common intent regarding the crime and functional control over the act must be recognized. We examine, from a legal standpoint, whether the conduct was merely a simple errand or an act following instructions, or whether it was in conspiracy with the organization.
Securing objective evidence and organizing statements
We secure materials such as mobile phone forensic data, messenger conversations, account transaction histories, and location information, and prepare so that consistent statements matching the facts can be made during the investigation.
Responding together to the foreign national's immigration procedures
For a foreign national, not only the criminal procedure but also procedures under the Immigration Act, such as visa cancellation and compulsory deportation, may proceed together, so we prepare a response plan that takes into account both the criminal case and the immigration offense examination.
