Through the procedure for acquisition of nationality by foreign nationals, you can eliminate the inconvenience of visa extensions and be guaranteed welfare benefits and legal rights as a Korean national. We explain the methods of acquiring Korean nationality.
Through the procedure for acquisition of nationality by foreign nationals, you can lawfully acquire nationality of the Republic of Korea.
However, because the Nationality Act involves complex procedures and documents, there are many cases where people who prepare on their own are refused due to incomplete documents or where it takes longer than expected.
In this article, we explain, clearly and simply, everything from the 4 main methods of acquiring nationality by foreign nationals (acknowledgment, naturalization, accompanying acquisition, and reinstatement of nationality) to the conditions, costs, and precautions.
Where do you apply for acquisition of nationality by foreign nationals?
To apply for acquisition of nationality by foreign nationals, you must file the report and application at the following nationality-affairs reception locations.

The methods of obtaining nationality of the Republic of Korea are broadly divided into four, depending on the applicant's situation.
Type of Acquisition | Main Eligible Persons | Key Requirements |
Acquisition of nationality by acknowledgment | A minor legally acknowledged by a Korean parent | Minor (under 19 years of age) + parent was Korean at the time of birth |
Naturalization (general, simplified, special) | A foreign national who has resided in Korea for a certain period | Period of residence, economic ability, basic knowledge (Korean language, etc.) |
Accompanying acquisition | The minor child of a parent applying for naturalization / reinstatement of nationality | A minor child who applies together when the parent applies |
Reinstatement of nationality | A foreign national who was formerly a Korean national | A history of holding Korean nationality in the past (not having posed danger or caused harm to the state or society) |
Among the ways foreign nationals acquire nationality, acquisition of nationality by 'acknowledgment' is a method by which a foreign minor, who was born to a foreign father or mother but whose parents were not married at the time of birth, obtains Korean nationality.
To acquire nationality by acknowledgment, a foreign national must prepare the following documents.
After preparing these documents and filing them with the immigration or foreign nationals office, once the report is accepted, the person acquires Korean nationality immediately.
This is the most representative method by which a person with no blood relationship to Korea can acquire nationality, and it is divided into general naturalization, simplified naturalization, and special naturalization.
① General Naturalization (residence of 5 years or more)
This is the type applied for by an ordinary foreign national who has no connection to Korea.
② Simplified Naturalization (3 years of residence or naturalization by marriage)
This is a system that reduces the period of residence for a foreign national who has a certain relationship (blood ties, marriage) with Korea.
1. Having continuously resided in Korea for 2 years or more while married to a Korean spouse
2. Having continuously resided in Korea for 1 year or more while married, after 3 years have passed since the marriage
3. Where the marriage was interrupted through no fault of the applicant, such as the death or disappearance of the spouse, but the remaining period has been fulfilled
4. Where the applicant is raising a minor child born of the marital relationship
③ Special Naturalization (relaxation of the residence period condition)
This is a type for talented individuals who have rendered special merit to Korea or who possess outstanding abilities.
Because the naturalization procedure involves a thorough review, it generally takes from several months to more than 1 year.
Stage 1 : Submission of Documents (immigration and foreign nationals office / for those under 15, a legal representative)
The application for permission of naturalization must be made by the person themselves, and documents must be prepared, including the application for permission of naturalization, a copy of the passport, a copy of the alien registration card, materials proving the ability of the applicant or a cohabiting family member at the same address to maintain a livelihood, a letter of recommendation, a family relationship report, and a criminal record certificate from the home country.

Stage 2 : Comprehensive Assessment of the Social Integration Program and Naturalization Interview Examination
The person must pass a written test that assesses the Korean language, Korean culture, and understanding of a multicultural society.
The comprehensive assessment must be taken within 1 year after the date of the naturalization application, and a score of at least 60 out of 100 is required to pass.
Minors, persons aged 60 or older, and some applicants for special naturalization may be exempted from the comprehensive assessment.
In addition, the naturalization interview examination assesses Korean language ability, one's attitude as a national of the Republic of Korea, and knowledge such as singing the national anthem through a one-on-one interview.
Stage 3 : Examination of Naturalization Requirements
This is the stage of verifying whether the documents submitted by the applicant are true and whether the applicant is actually living honestly in Korea.
An on-site investigation may be conducted to check whether the person is actually living well at their registered address, and it is verified whether the person has a stable income enabling them to reside in Korea.
In particular, to prevent a sham marriage entered into solely to acquire Korean nationality, it is strictly verified whether the applicant is actually maintaining a normal marital relationship with the spouse.
Stage 4 : Decision on whether to grant permission of naturalization after the Ministry of Justice's criminal record check, background check, and other reviews
Stage 5 : After receiving permission of naturalization, acquiring the nationality of the Republic of Korea immediately upon taking the citizens' oath and being awarded the naturalization certificate
Stage 6 : After acquisition of nationality, renunciation of foreign nationality or a pledge not to exercise foreign nationality
What is important is that within 1 year after obtaining Korean nationality, the person must renounce their foreign nationality or make a pledge not to exercise foreign nationality.
If the person makes a pledge not to exercise foreign nationality, they may maintain dual nationality (multiple nationality).

Among those wishing to acquire nationality as foreign nationals, some were formerly Korean nationals but lost their Korean nationality upon acquiring a foreign nationality through emigration, study abroad, marriage, and the like, and they may recover Korean nationality again.
This is called reinstatement of nationality, and in this case the person must be able to prove the fact that they were formerly a Korean national.
However, a person who renounced nationality for the purpose of evading military service, a person who caused danger or harm to the state or society (posing danger and causing harm), or a person of poor conduct may be refused reinstatement of nationality (not granted permission).
In addition, accompanying acquisition means applying for nationality acquisition together with a child; if a parent has a minor (under 19 years of age) child when applying for permission of naturalization or reinstatement of nationality, the procedure is carried out together.
In this case, the moment the parent acquires nationality, the child simultaneously acquires Korean nationality without any separate, complex naturalization requirements.
Acquisition of nationality by foreign nationals is a specialized procedure that requires a detailed review of complex legal factors, such as each individual foreign national's history of stay, family relationships, proof of income, and whether there is a criminal record.
The attorneys at the foreign nationals litigation law firm inform each client of the nationality acquisition method that is most advantageous and fastest for them.
